iThoughts (Mac and Windows) - End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and toketaWare ltd. (herein referred to as "TOKETAWARE") with regard to the copyrighted software iThoughts for Windows or Mac (herein referred to as "SOFTWARE PRODUCT" or "SOFTWARE") provided with this EULA. 

1. License Grant. 

TOKETAWARE grants to you a personal, non-transferable and non-exclusive right to use the SOFTWARE provided with this EULA. The right to use the SOFTWARE also extends to immediate family members sharing a single residence.

2. Copyright. 

The SOFTWARE is licensed, not sold. You acknowledge that no title to the intellectual property in the SOFTWARE is transferred to you. 

Stock icons and images are Copyright INCORS GmbH. Exported documents containing INCORS icons can be freely redistributed. Icons may not be extracted from exported documents to be reused or resold without permission from INCORS GmbH.

3. Disclaimer of Warranty. 

The SOFTWARE is provided "AS IS" without warranty of any kind. TOKETAWARE disclaims and makes no express or implied warranties and specifically disclaims the warranties of merchantability, fitness for a particular purpose and non-infringement of third-party rights.

4. Limitation of Liability. 

TOKETAWARE's entire liability and your exclusive remedy under this EULA shall not exceed the price paid for the SOFTWARE, if any. In no event shall TOKETAWARE or its suppliers be liable to you for any consequential, special, incidental or indirect damages of any kind arising out of the use or inability to use the SOFTWARE.

5. Rental. 

You may not loan, rent, or lease the SOFTWARE. 

6. Resale. 

You may not resell the SOFTWARE. 

7. Organisations.

Licenses cannot be shared between people. Where an organisation has purchased a license, it it their responsibility to ensure that the license is allocated to a single person exclusively. Once allocated, the license must remain allocated to that person for a minimum of 1 month (or until that person leaves the organisation.)
